Fletcher, Heald & Hildreth, PLC assists broadcasters, cable operators, telecommunications providers, registries, registrars, and other companies and organizations with any and all matters relating to online privacy. FHH attorneys seek to ensure that online services comply with all applicable regulatory requirements, including, for example, the need to protect personal data obtained from subscribers, customers, browsers and other users. In so doing we help clients provide a safe experience for subscribers, customers, browsers and other users who want assurance that their personal data will be protected, and we help safeguard website owners and operators from liability.
Our services include advising clients about:
- Federal laws, and implementation of those laws by various federal agencies (including, most notably, the Federal Trade Commission), applicable to websites, mobile applications, and social media. In this connection FHH attorneys assist clients in drafting appropriate policies relative to the collection, use, transfer, and disposal of personally identifiable information obtained through web sites. Where applicable, particular attention is paid to laws protecting children, most notably the Children’s Online Privacy Protection Act (“COPPA”) and federal cable TV privacy regulations governing access to subscriber information;
- State privacy laws and agency regulations; and
- Understanding of and compliance with international data protection requirements. FHH attorneys assist clients who serve international markets to comply, where necessary, with the data protection laws adopted by all countries of the European Union, as well as Canada, Japan and South Korea.
